about medical marijuana

Massachusetts marijuana laws

Massachusetts does not allow medical marijuana, but the Legislature's public health committee held hearings on a bill this spring that would allow patients with

specified conditions to use marijuana with written certification from a physician or other practitioner licensed to prescribe controlled substances.

Last year, voters approved ballot Question 2, which removed the possibility of jail for simple marijuana possession. Now, possession of an ounce or less is

punishable by only a $100 fine and forfeiture of the marijuana. That ballot initiative did nothing to change the law regarding drug paraphernalia -

such as the machines that vaporize marijuana. This means that vaporizers are "probably'' still illegal, says Michael Cutler, a lawyer.

July 15,2009 Hawaii BREAKING NEWS: Lawmakers Override Governor -- Approve Medical Marijuana Task Force Bill

On Wednesday, July 15, hawaii lawmakers voted 38 to 9 to override Republican Gov. Linda Lingle's veto of Senate Bill 1058,

which calls on a study committee to examine options for providing state-authorized patients with access to medical cannabis.

Senate Bill 1058 establishes a special legislative task force to "report on the policies and procedures for access, distribution,

security, and other relevant issues related to the medical use of cannabis for all the states that currently have a medical cannabis

program." The task force will be comprised of 13 members, including leaders from the Drug Policy Forum of Hawaii,

the West Oahu Hope for a Cure Foundation, Americans for Safe Access, and a medical cannabis patient who is

appointed by the Governor. Under the state's medical marijuana law, which was enacted by the legislature in 2000,

over 3,000 Hawaiians are registered with the state to possess and or cultivate cannabis.

NORML would like to thank those of you who took the time to contact your elected officials and urge their support

for this legislation.

2010-02-03 HerbFolks.org Apples and Oranges? Do American Medicinal Cannabis patients smoke swag?

As you all KNOW, those who are legit patients here in California (the state with the herb loving hypocrite Governor), "mec'

'weed' is just that. It is not medical grade, typically, and is rarely offered as such in the US.

BUT, foreign drug cartels as opposed to domestic drug cartels (AMA,CVS,RJ Reynolds, et al), not to be confused with

prison led US street gangs, will continue to infiltrate the medical cannabis world, and make headway, if the current war

on patients is allowed to continue unabated. We need safe access to domestic medical grade, now. Nothing short of this will

suffice. In your discussions with non herb knowledgeable folks, inform them of the difference between 'mec' and medical herb.

This is just a starting point for dialog. Redirect their attention to US patients, not allowing them to essentially change the subject

to 'cartels'. Apples and Oranges...

Former Mexican official urges legalizing marijuana

CNN International - Tom Evans -

(CNN) -- The United States and Mexico should both legalize marijuana in an attempt to break the power of the Mexican drug cartels and end the spiraling violence south of the border, a former Mexican foreign minister said Tuesday. Jorge Castaneda, in an interview with CNN's Christiane Amanpour, said marijuana "should be legalized in both countries," and said it is ridiculous for Mexico to try to stop marijuana from entering the United States when it's legally sold for medical purposes in California. "The Drug Enforcement Administration says that 60 percent of the Mexican (drug) cartels' profits come from marijuana. If we start with that, it's a big chunk," he added. "We can't do everything overnight ... and we can't do it in Mexico if the U.S. doesn't do it at the same time."...

2010-02-01 Dwarf strains

http://www.daybrown.org outlines my ongoing medical
marijuana test case in Van Buren County AR.

But part of my defense is that the new dwarf strains are so small, the
chopper had to get down to treetop level to see it, and as seen in the
crime scene photos taken at my place, blew all the leaves down off the
tree that was over my medical mj pot patch.

This is a footprint on the property before a search warrant is
granted. It is also a risk to all landowners, that pot may be grown on
their land without their being aware of it until the cops show up to
bust them and seize the property. According to the asset seizure law,
the landowner hasta prove he didnt grow it or know it was there.

If you make landowners aware of the risk to their property rights, the
whole system will quickly fall apart. Even if they do keep their land,
they still need to hire a lawyer to defend the case in court. Which is
what the drugwar has always been about. Making money for lawyers.

Initiative Filed to Legalize Marijuana in Washington State

Five activists filed a ballot initiative Monday that would legalize all adult marijuana possession,

manufacturing and sales under Washington state law — one of the most sweeping efforts at marijuana

reform playing out around the country this year.

Its sponsors include two Seattle lawyers and the director of Seattle’s annual Hempfest. They call

themselves Sensible Washington, and say that in a time of dire budget woes, the state’s government

should stop spending money on police, court and jail costs for people who use or produce marijuana.

THOUGHTS ON CANNABIS
"How many murders, suicides, robberies, criminal assaults, holdups, burglaries and deeds of maniacal insanity it causes each year, especially among the young, can only be conjectured...No one knows, when he places a marijuana cigarette to his lips, whether he will become a joyous reveller in a musical heaven, a mad insensate, a calm philosopher, or a murderer..."

This report from the New York Times tells readers about the death of Peter McWilliams.  The feds said he was a “drug dealer.”  McWilliams also wanted to tell his story to a jury, but pled guilty when the judge told him he would not be allowed to inform the jury of his medical condition.  Excerpt:  “At his death, Mr. McWilliams was waiting to be sentenced in federal court after being convicted of having conspired to possess, manufacture and sell marijuana…. They pleaded guilty to the charge last year after United States District Judge George H. King ruled that they could not use California’s medical marijuana initiative, Proposition 215, as a defense, or even tell the jury of the initiative’s existence and their own medical conditions.”  The late William F. Buckley wrote about McWilliams’ case here.

2009-11-26 Help us Hit 50!

28 Members of Congress have already cosponsored the Truth in Trials Act.  That's a great start, but there are a total of 435 members in the US House of Representatives!

Help us reach our next goal:  getting 50 Members of Congress to cosponsor the bill.  Please write a letter to your U.S. Representative.  Urge him or her to "cosponsor HR 3939, the Truth in Trials Act."

Tell your Member of Congress that medical marijuana patients should be able to tell a federal court that they were following state law.

You can find your Member of Congress by typing your zip code here:
http://www.house.gov
You might need to include your full "Zip+4", which you can find on the last piece of junk mail you received.

Read about the Truth in Trials Act here:

Urge Your U.S. Representative to cosponsor Truth in Trials!

One in four Americans now lives in a state with laws governing medical marijuana.  Unfortunately, law-abiding citizens can still be prosecuted on federal marijuana-related charges.

Even with the Obama Administration’s new guidelines, federal prosecutors can still block defendants from showing that they were in compliance with state law.

The “Truth in Trials” Act, H.R. 3939, would end this injustice by ensuring that federal defendants could present evidence showing that they were following state law.  Introduced by US Representative Sam Farr, this important legislation would give law-abiding citizens the ability to defend themselves in federal court.

Urge your Member of Congress to cosponsor "Truth in Trials" today.

WAGE PEACE!
