2010-02-02 18:33 COLLECTIVE ALERT:  Two collectives or more have reported individuals who have appeared at collectives purporting to be "medical marijuana task force" representives, "city committee" representatives or other sort of "collective experts".  In two cases it has been a woman, in one case a man.  These people seek to gain information about the collective and how it is run.
Please remember that there are those who dispute the meaning of the law, and those who seek to undermine it.

NORML stands behind the belief that all collective owners should be working with an attorney.  Anybody who says otherwise is either naive, or has ulterior motives.

DO NOT SHARE SENSITIVE INFORMATION WITH PEOPLE WHO HAPPEN TO SHOW UP AT YOUR COLLECTIVE, REGARDLESS OF WHO THEY PURPORT TO BE.

Uptown Community Planning Committee

On Tuesday February 2, 2010 the Uptown Community Planning Committee will discuss medical marijuana task force recommendations. The Uptown Community Planning Committee is one of the groups that make up the CPC. The Uptown CPC will vote on recommending that the City Council adopt an ordinance which will allow medical marijuana collectives to apply through a process 3 Conditional Use Permit. Please come out and support the Uptown CPC as they will discuss regulating safe access to medical marijuana in San Diego.

Uptown CPC Medical Marijuana Agenda Item:
MEDICAL MARIJUANA TASK FORCE RECOMMENDATIONS – Request by the City Council of the City of San Diego for its Community Planning Groups to make review and comment on the issue: Motion by Wilson; second by Lamb:

1. To implement the intent of the voters in enacting Proposition 215, the City of San Diego should establish a conditional use permit (CUP), process by which medical marijuana dispensaries may operate. Applications for such a CUP will be reviewed under a Process Three procedure – the initial decision would be make by a hearing officer; whose decision is appealable to the Planning Commission;

2. In drafting the enabling ordinance for the CUP process, it is recommended the City of San Diego review and consider incorporating applicable provisions from the draft ordinance prepared by Jeffrey A. Lake, Esq., and put forward by Southern California NORML: subject to revision to incorporate the City Council’s Medical Marijuana Task Force recommendations;

3. The CUP permitting process should require all medical marijuana dispensary applications to contain the governing document for each collaborative or cooperative; which should:

(1.) Identify the individual organizers and principal operators of the collaborative or cooperative;

(2.) Specifically identify how the collaborative or cooperative will be governed and operated, and what will be its administrative structure;

4. The CUP permitting process should also require a verifiable accounting and bookkeeping procedure be instituted at each medical marijuana dispensary, in accordance with standard accounting procedures. All dispensaries should be subject to annual audit; obtain business licenses; and pay taxes and all applicable fees.

San Diego Alert: Collective Advisor Scam

 

Please be aware that in these turbulent political times, a variety of scams are popping up.  One of them involves people who may appear to you and represent themselves as experts in the operations of collectives.  It is NORML's position that you speak with an attorney regarding details of legally operating a collective. People who appear to you claiming that they have run a collective and are experts on it are not qualified to give legal advice.  It is an automatic red flag when these individuals begin asking for pointed questions about how you run your collective.  Not only are such individuals not experts, they may be working as confidential informants.  Further information has turned up that money has been allotted to confidential informants "based on the quality of their information".  Regardless of how well you are following the law and the AG guidelines, you are at some risk and should protect yourself.  Due to the precarious nature of San Diego County's position on medical marijuana, we advise that you err on the side of caution and discuss specific issues of YOUR collective ONLY with a qualified attorney.

Further, you should protect yourself from potential further harm by not allowing anyone other than your attorney, or yourself or working members of your collective to have access to your computer.  There have been reports of people who have frequented collectives to ingratiate themselves. They then offer to "make sure the collective is doing things right".   The next step is requesting access to your computer to help you.  They can easily install software that will allow them access to your computer from remote locations.  They also may be digging for information.  You are placing yourself at extremely high risk by allowing people not directly associated to your collective to have access to your computer.

Further, nobody in this community, other than law enforcement, and city or county officials can order you to comply with their recommendations.  We have also received reports of individuals entering collectives with an air of authority and demanding compliance with what they deem to be offensive to them.  People can make suggestions, and you can listen if you choose, but there is no individual or group who has the right to "sanction" or "protect" you if you do what they say.  There are also reports of individuals offering monthly memberships for which they will "protect" you from arrest.  There is nobody who can offer that complete immunity from arrest. 

We have also received reports that collectives have received payment demands that appeared to be from the government, but were actually false letters from someone clearly committing fraud.  And finally, please report anybody who claims to guarantee that you will as some point receive a business license if you give pay them.

Again, we advise that you confer with your attorney on how best to stay protected.

Action Alert: government troops are coming to town!
 
 We need to be prepared and plan to protest this! The weekend that camp is here for we will need to set up protests so that we are there for the entire time. Please email me so we can set up focalizers for each day of the protest if you are interested in helping. This will happen in May.
